Bloqworx Terms of Service

Welcome to Bloqworx! These Terms of Service ("Terms") govern your access to and use of Bloqworx, our mobile applications, APIs, widgets, and any other products or services we provide (collectively, the "Services"). Please read them carefully—by accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not access or use the Services.

1. Who We Are

Bloqworx ("Bloqworx", "we", "us", or "our") is a Limited Liability Corporation that provides a no‑code website builder, blogging engine, and related tools designed for creators, small businesses, and entrepreneurs.

2. Eligibility & Account Registration

You must be at least 13 years old (or the age of digital consent in your jurisdiction, whichever is higher) to create an account. When you register, you agree to:

Provide accurate, current, and complete information
Maintain the security of your password and API keys
Promptly update your information so it remains accurate

You are responsible for all activity that occurs under your account. Bloqworx is not liable for any loss or damage arising from your failure to safeguard credentials.

3. Subscription Plans & Payment

Certain features require a paid subscription ("Paid Services"). By subscribing, you authorize us (or our third‑party payment processor, such as Stripe) to charge your payment method on a recurring basis until you cancel. Prices, billing cycles, and included features are described on our Pricing page.

Trials. If you start a free trial, we will automatically charge at the end of the trial unless you cancel beforehand.
Taxes. Prices do not include taxes or duties. You are responsible for all applicable taxes.
Cancellation. You may cancel at any time from your dashboard. Payments are non‑refundable except as required by law.

4. Your Content

"User Content" means any text, images, video, code, data, or other materials you upload or publish through the Services.

Ownership. You retain all rights to your User Content. Bloqworx does not claim ownership.
License to Bloqworx. You grant Bloqworx a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, display, and distribute your User Content solely to operate and improve the Services.
Responsibility. You are solely responsible for your User Content and the consequences of posting it. Do not upload content that is illegal, infringing, harmful, or violates our Community Guidelines.

5. Templates & Components

Bloqworx offers proprietary templates, components, and design assets ("Bloqworx Assets"). Bloqworx Assets are licensed, not sold. Subject to your compliance with these Terms and any plan limits, Bloqworx grants you a limited, non‑transferable license to use Bloqworx Assets within websites you build using the Services. You may not resell, redistribute, or create competing products with Bloqworx Assets.

6. Prohibited Conduct

You agree not to:

Use the Services for unlawful, deceptive, or fraudulent purposes
Reverse engineer, decompile, or attempt to discover source code
Circumvent storage, bandwidth, or feature limitations
Interfere with or disrupt the integrity or performance of the Services
Upload viruses, malware, or other harmful code
Misrepresent your identity or affiliation with any person or entity

We reserve the right to investigate violations and suspend or terminate accounts at our sole discretion.

7. Intellectual Property

The Services, Bloqworx Assets, trademarks, logos, and all related intellectual property are owned by Bloqworx or its licensors and are protected by U.S. and international laws. Except for the limited license granted in Section 5, nothing in these Terms transfers any intellectual property rights to you.

8. Beta Features

We may offer preview or beta features ("Beta Services"). Beta Services are provided "as is" without warranties and may be discontinued at any time. Your use is voluntary, and you acknowledge that Beta Services may be unstable or incomplete.

9. Termination

You may stop using the Services at any time. Bloqworx may suspend or terminate your access for any breach of these Terms, unlawful behavior, or to protect the Services or other users. Upon termination, all licenses granted to you will cease, and your User Content may be deleted.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE"WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. QUILIO DOES NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUILIO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTly, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF THE SERVICES; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; OR (C) ANY OTHER MATTER RELATING TO THE SERVICES. IN NO EVENT SHALL QUILIO’S TOTAL LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless Bloqworx and its affiliates from any claims, damages, liabilities, and expenses (including attorneys’ fees) arising out of or related to your use of the Services or violation of these Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, excluding its conflict‑of‑laws principles. Any dispute arising out of these Terms or the Services shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the revised Terms and updating the “Last updated” date. Your continued use of the Services after changes become effective constitutes acceptance of the new Terms.

15. Miscellaneous

Entire Agreement. These Terms constitute the entire agreement between you and Bloqworx.
Severability. If any provision is held invalid, the remaining provisions will remain in full force.
No Waiver. Our failure to enforce any right or provision is not a waiver of future enforcement.
Assignment. You may not assign these Terms without our prior written consent. Bloqworx may assign its rights without restriction.
